Sydney firm convicted of obstructing union safety inspection

A Sydney company has been convicted in the NSW Chief Industrial Magistrate's Court of unlawfully obstructing union officials investigating suspected breaches of the Occupational Health and Safety Act 2000.

Two Shop Distributive and Allied Employees Union (SDA) officials were ordered to leave the premise of Ourcorp Pty Ltd by the company's warehouse manager while conducting a safety inspection on 23 September 2004.

The officials complied with the order to leave and reported the incident to WorkCover NSW.

Ourcorp Pty Ltd was convicted with two charges under Section 136(1)(a) of the Occupational Health and Safety Act 2000, which states that a person must not "obstruct, hinder or impede any unauthorised official in the exercise of the official's function under the Act".

The union officials went to the warehouse to conduct an inspection in response to complaints from the SDA over safety issues.
