2.8m fall lands building and maintenance company $390,000 fine
As a result of a prosecution by SafeWork NSW, a building and maintenance company has been fined $390,000 in the Industrial Court of NSW.
The proceedings arose from a 23 October 2023 incident in which a worker fell from a 2.8 metre height through a skylight void from one level to another and was seriously injured.
“SafeWork NSW takes falls from heights seriously. Preventing injuries caused by a fall is an area for action in SafeWork NSW’s regulatory priorities this year,” said SafeWork NSW Commissioner Janet Schorer.
“Falls from heights are a primary cause of traumatic injuries and fatalities in NSW workplaces.
“SafeWork NSW reminds all businesses of their duty to ensure their workers are protected when working with potential falling hazards and working at heights.”
The company pleaded guilty to an offence pursuant to section 32 of the Work Health and Safety Act 2011 for failing to comply with its health and safety duty to workers under section 19(1) of the Act. The company has the right to appeal against the sentence.
